In Xinjiang Urumqi, Altay and other regions, we found that many mosques were posted with eye-catching notices at the door: “No public servants or minors are allowed to enter” government announcements. We think this is a very inappropriate approach. ^fb0438

In recent years, with some changes in the international community, the unstable factors caused by religious issues in China have become increasingly prominent. The relevant departments have taken necessary precautions and taken some measures. However, in view of the complexity of religious issues and the problems in border areas For issues left over from history, although great efforts have been put in, hidden dangers have emerged in the process of maintaining stability, and the effect has not been satisfactory to all sectors of society.

Religious issues are essentially ideological issues. Relying on external high-pressure and controlled behavior cannot completely solve the problem. It can even cause psychological resistance among believers, which is often counterproductive. According to the principle of “separation of politics and religion, and the separation of religion and education” in my country’s Constitution, the ban is theoretically reasonable. However, in areas where Islam has a broad social foundation, according to Islamic teachings, the descendants of Muslims are naturally Muslims, and Muslims are not allowed to separate from Islam, and violators may even be punished by violence. Local public servants and their families are probably Muslims, and the mosque is a place where every Muslim must go in and worship.

  1. This regulation directly caused the public antagonism between public servants and other Muslims in the local area, and the settlement of many social affairs must be carried out by public servants. Therefore, the ban is extremely detrimental to the government’s understanding of the internal ideological dynamics of Muslims and the infiltration of religious forces.

  2. On the other hand, public servants may not go to mosques for worship because of the ban, but they may not agree with this behavior deep down. Once they cause a psychological plan and encounter possible dissatisfaction at work, they can easily develop into a bad religion. The sympathizers of the forces have become “time bombs” used by religious forces.

  3. The Civil Service Law does not prohibit going to religious places during private time, and the prohibition cannot be followed.

To this end, we recommend:

  1. Internal disciplines can be used to restrain public servants from paying visits to worship five times a day in accordance with strict Islamic teachings, and they can also be required not to go to mosques to participate in religious activities during working hours. However, it is not possible to publicly create “antagonism” outside the mosque in the form of a ban. In addition, public servants who participate in religious activities in their spare time can be required to report the details of the activities of the day, and conduct a comprehensive analysis of the reports of different personnel to grasp the overall dynamics of local religious development.

  2. For minors, according to the Constitution, the Law on Compulsory Education, and the Law on the Protection of Minors (adjusting or adding necessary relevant provisions), they can continue to require that they not enter the mosque to participate in religious activities, but the ban on the announcement must state religious and educational thoughts. The basic principle of separation, and advertised widely.

  3. For ethnic minority areas, separate Uighur language schools will be abolished, and all schools will be adjusted to bilingual schools to eliminate the growing influence of Islam in Uighur language schools. Because once the local people can freely choose between Uighur language schools and Chinese schools, students and parents who do not choose Uighur language schools will face huge pressure from Muslim society. According to our interviews, many Uighur language schools have developed into closed circles. , Minors are extremely vulnerable to extreme thoughts. The abolition of Uyghur schools and the full implementation of bilingual schools can prevent minors from falling into a closed and exclusive religious and social environment in accordance with the Compulsory Education Law, which is necessary for long-term social stability.

  4. Fourth, at the final level, long-term and meticulous efforts are needed to make legal governance a consensus regardless of ethnicity and religion, in order to effectively curb potential social crises caused by ethnic and religious issues.

# 建议取消“禁止公务人员及未成年人进入清真寺”的禁令

在新疆乌鲁木齐、阿勒泰等地区,我们发现众多清真寺门口用醒目的告示张贴着:“禁止任何公务人员、未成年人进入”的政府公告。我们认为这是很不恰当的做法。

近年来随着国际社会发生的一些变化,宗教问题在国内导致的不稳定因素日渐突出,相关部门对此进行了必要的防范并采取了一些措施,但是鉴于宗教问题的复杂性,以及边疆地区的历史遗留问题等,虽然投入力量很大,维稳过程中依旧隐患曾出,效果并不能令社会各界满意。

宗教问题本质上是意识形态的问题,依靠外界高压及控制行为并不能彻底解决问题,甚至还会造成信众的心理抵触,往往适得其反。根据我国宪法关于“政教分离、宗教和教育分离”的原则,理论上,该禁令有其合理性。但是,在伊斯兰教具有广泛的社会基础的地区,根据伊斯兰教义,穆斯林的后代天然是穆斯林,且穆斯林不得脱离伊斯兰教,违反者甚至会遭受暴力惩戒。当地的公务人员及其家人很可能就是穆斯林,而清真寺是每一个穆斯林都必须进去礼拜的地方。

1、该规定直接造成了公务人员在当地和其他穆斯林之间的公开对立,而众多的社会事务的解决又都必须依靠公务人员去执行。所以,该禁令对于政府部门了解穆斯林内部的思想动态、宗教势力的渗透情况的掌握都是极为不利的。

2、另一方面,公务人员可能因为禁令不去清真寺进行礼拜,但内心深处未必会赞同这种行为,一旦引起心理方案,又在工作中遇到了可能的不满,则很容易发展成不良宗教势力的同情者,成为被宗教势力利用的“定时炸弹”。

3、公务员法并没有禁止在私人时间前去宗教场所,禁令无法可依。

为此,我们建议:

一、可以通过内部纪律约束公务人员按照严格的伊斯兰教教义规定的一日五次参拜,也可以要求不得在工作时间前往清真寺参与宗教活动。但不可以在清真寺外以禁令的方式公开制造“对立”。另外,可以要求业余时间参加宗教活动的公务人员必须汇报当日活动详情,对不同人员的汇报进行综合分析,以掌握当地宗教发展的整体动态。

二、对于未成年人,则根据宪法、义务教育法、未成年人保护法(调整或者增加必要的相关条款)可以继续要求不得进入清真寺参与宗教活动,但公告的禁令中必须阐明宗教与教育想分离的基本原则,并广而告之。

三、对于少数民族地区,取消单独的维语学校,所有学校均调整为双语学校,杜绝现在伊斯兰教在维语学校中日渐广泛的影响力。因为一旦当地群众可以在维语学校和汉语学校中自由选择,不选择维语学校的学生和家长会面临巨大的穆斯林社会压力,根据我们的走访了解,很多维语学校已经发展成封闭的小圈子,未成年人极容易受到极端思想的影响。取消维语学校,全面开展双语学校,可以根据义务教育法,防止未成年人陷入封闭的、排他式的宗教和社会环境,对长期的社会稳定十分必要。

四、最终层面,需要通过长期、细致的努力,让法制治理成为无论什么民族和宗教的共识,才能有效遏制由民族和宗教问题引发的潜在社会危机。
